(RightIsRight.co) – In a major victory for conservatives and the rule of law, a federal court has blocked Joe Biden and Kamala Harris’ brazen attempt to grant mass amnesty to hundreds of thousands of illegal aliens.
The ruling reaffirms states’ rights to challenge federal overreach on immigration policy and delivers a stinging rebuke to the Biden administration’s open borders agenda.
Judge J. Campbell Barker of the U.S. District Court for the Eastern District of Texas ruled against the Biden administration’s “Keeping Families Together” program.
The program sought to allow illegal alien spouses of U.S. citizens to apply for lawful permanent residence without leaving the country. This would have provided a pathway to citizenship for up to 500,000 illegal aliens who have been in the country for over a decade.
The court’s decision came after a coalition of 16 states, led by Texas and Idaho, partnered with the conservative organization America First Legal to challenge Biden’s executive order.
Judge Barker, appointed by President Donald Trump, determined that the Department of Homeland Security (DHS) lacked the statutory authority to implement such a sweeping amnesty program.
Moreover, this ruling represents a significant setback for the Biden administration’s efforts to circumvent Congress and unilaterally rewrite immigration law.
Current regulations require illegal aliens to leave the U.S. and apply for legal status from abroad after marrying a U.S. citizen – a process that helps maintain the integrity of America’s immigration system.
The executive director of America First Legal, Gene Hamilton, said, “Since day one, the Biden-Harris Administration has dedicated itself to the decimation of our immigration system and the erasure of our borders.”
The blocked program would have allowed eligible illegal aliens, spouses, and stepchildren to remain in the U.S. for three years while applying for permanent residency, effectively rewarding those who broke the immigration laws with a fast track to citizenship.
One of the state leaders who joined the lawsuit, Missouri Attorney General Bailey, praised the court’s decision and highlighted the ongoing crisis at the southern border created by the Biden administration’s lax policies.
“Joe Biden and Kamala Harris created a crisis at the southern border, leaving the American people to pay the consequences. In the wake of the federal government’s refusal to act, states like Missouri had no choice but to step in and take action to secure our southern border,” he said.
This latest court ruling adds to a string of legal defeats for the Biden administration on immigration policy.
In a separate case, a federal judge in San Francisco recently struck down another key aspect of Biden’s border strategy, declaring the asylum rule at the southern border “both substantively and procedurally invalid.”
As the Biden administration continues to prioritize the interests of illegal aliens over those of American citizens, it is clear that only through action by conservative state leaders and organizations can Americans preserve the rule of law and protect the nation’s sovereignty.
